Terms of Service

1. Agreeing to These Terms

These terms are an agreement between you and KrashWagers, the company based in Ontario, Canada that operates KrashBoard ("KrashWagers", "KrashBoard", "we", "us"). They apply to krashboard.app, the KrashBoard Discord bot, and every tool and page we offer (together, the "service"). By using the service, including the free pages you can use without an account, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

You must be at least 21 years old to use KrashBoard. By using the service you confirm that you are, and that using sports betting research tools is legal where you live.

2. What KrashBoard Is, and Is Not

KrashBoard provides sports data, statistics, model projections, odds comparisons and research tools for informational and entertainment purposes only.

KrashBoard is not a sportsbook. We do not accept, place, or settle wagers, and we have no access to your sportsbook accounts.

Nothing on KrashBoard is advice. Projections, grades, ratings, picks, edges and any other output are opinions and estimates, not financial, betting, or professional advice, and not a promise of any result. Past performance does not predict future results. Every decision to bet is yours alone, and you are responsible for following the laws that apply to you.

Gambling involves risk. Never bet more than you can afford to lose. If you or someone you know has a gambling problem, call 1-800-GAMBLER.

3. Free and Paid Access

Some pages are free and can be used without an account. Full access requires either a paid KrashBoard subscription or a verified OnlyParlays VIP membership through Discord. We decide which features are free and which are paid, and we may change that at any time.

If you create an account, give us accurate information, keep your login details secure, and do not let anyone else use your account. You are responsible for activity under your account.

4. Subscriptions, Renewal and Cancellation

Automatic renewal. Paid plans renew automatically. When you subscribe, you authorize us, through our payment processor Stripe, to charge your payment method the plan price shown at checkout at the start of each billing period (monthly, every 3 months, every 6 months, or yearly, depending on the plan you chose) until you cancel.

Cancelling. You can cancel at any time online from the Subscription section of your Settings page, which opens the Stripe billing portal. Cancellation stops the next renewal. You keep access until the end of the period you already paid for.

Refunds. Payments are non-refundable, and we do not give refunds or credits for partly used periods, unless the law where you live requires it. Deleting your account cancels your subscription immediately and ends access without a refund.

Price changes. We may change subscription prices. We will tell you by email before a new price applies to you, and it will take effect at your next renewal. If you do not want to pay the new price, cancel before that renewal.

OnlyParlays memberships are sold and billed by OnlyParlays through DubClub, not by KrashBoard, and their terms apply to that purchase.

5. Acceptable Use

You agree not to:

• share your account, resell access, or let others use your login;
• scrape, crawl, copy in bulk, or automatically collect data from the service, or use bots to access it;
• republish or redistribute our data, projections or tools as your own product;
• reverse engineer the service or try to get around access limits or paywalls;
• interfere with the service, its security, or other users;
• use the service to break any law, including gambling laws where you live.

We may suspend or close accounts, or block access, that we reasonably believe break these rules.

6. Content You Share

Some features let you share content publicly, such as your profile, handle, avatar, picks, ratings and community parlays. You keep ownership of what you share. You give us a free, worldwide licence to host, display and share it inside the service for as long as it is posted. You can email us at any time to remove shared content or make your profile private.

Do not share anything unlawful, abusive, misleading, or that you do not have the right to share. We may remove any content at our discretion.

7. Our Content and Third-Party Marks

The service, including its design, software, models, projections and compiled data, is owned by KrashBoard and protected by law. We give you a personal, non-transferable right to use it for your own non-commercial research while you follow these terms.

Team names, logos, player images and sportsbook names belong to their owners and are used only to identify them. KrashBoard is not affiliated with, endorsed by, or sponsored by any league, team, player, or sportsbook.

8. Third-Party Links and Services

The service links to sites we do not control, including sportsbooks, Discord and OnlyParlays. Some of those links are affiliate links. We are not responsible for third-party sites, their content, or what happens when you use them.

9. No Guarantees

Our data comes from third-party sources and our models are estimates. Odds, lines, injury news and statistics can be late, incomplete or wrong.

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement.

We do not promise that the service will be available at any particular time, without interruption, or free of errors. We may change, pause, or discontinue any feature at any time.

10. Limitation of Liability

To the fullest extent the law allows, KrashBoard will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, wagering losses, lost data, or loss of goodwill, arising from or related to your use of the service, even if we were told such losses were possible.

Our total liability for any claim arising from or related to the service or these terms is limited to the greater of (a) the amount you paid KrashBoard in the 12 months before the claim, or (b) US$50.

Some places do not allow certain of these limits, so some may not apply to you.

11. Indemnity

If someone brings a claim against KrashBoard because of your breach of these terms, your misuse of the service, or content you shared, you agree to cover the reasonable costs and losses that result, including legal fees.

12. Ending Your Use

You can stop using the service and delete your account at any time from Settings. We may suspend or end your access if you break these terms or if we stop offering the service. Sections 2, 6 to 11, 14 and 15 continue to apply after your access ends.

13. Changes to These Terms

We may update these terms. The date at the top shows the latest version. If we make a material change, we will tell account holders by email or through the site before it takes effect. Using the service after a change takes effect means you accept the new terms.

14. Disputes

If you have a problem with KrashBoard, email us first so we can try to fix it. If we cannot resolve it within 30 days, either of us may take it further.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules. Any dispute will be heard only in the courts of the Province of Ontario, and you and KrashWagers agree to those courts' jurisdiction. Either of us may instead bring an individual claim in small claims court where it qualifies. Nothing in these terms removes consumer rights that the law where you live says cannot be waived.

15. General

These terms and the Privacy Policy are the whole agreement between you and KrashBoard about the service. If any part is found unenforceable, the rest still applies. If we do not enforce a term right away, we have not given up the right to enforce it later. You may not transfer your rights under these terms. We may transfer ours, for example if KrashBoard is sold.
